Trade Update - March 3, 2025

U.S. Customs and Border Protection has issued additional guidance concerning the new tariffs against products of Canada and Mexico effective March 4, 2025. However, de minimis entry processing will remain in effect for those countries until further notice.

President Trump has also issued an Executive Order to increase the tariff imposed against China on February 4th from 10% to 20%. The effective date is not yet specified.

The Department of Commerce has announced a partial implementation of the Section 232 Steel and Aluminum tariffs on derivative articles. The Administration has set an earlier effective date of March 12, 2025 for the derivative tariff provisions in Chapters 73 and 76 while allowing additional time to work out how to implement the tariffs on articles classified under other Chapters of the HTS.

The United States Trade Representative (USTR) is seeking comments concerning non-reciprocal trade practices. The request comes after President Trump’s announcement of the “Fair and Reciprocal Plan” and executive order calling for an investigation into other countries’ trade policies. Public comments to the USTR are due March 11, 2025. The report on the results of the investigation is due on April 1, 2025. Additional information on the reciprocal tariff plan can be found here.

An Executive Order has been issued to commence a Section 232 investigation targeting copper products. This investigation will cover copper in all forms raising the prospect for additional tariffs in the near term, including copper exports from China.
