USTR Extends Certain Exclusions from China Section 301 Tariffs

The U.S. Trade Representative (USTR) announced today that certain exclusions from China Section 301 tariffs are being extended while others are being discontinued.

In prior notices, the USTR modified the actions in the Section 301 investigation of China’s acts, policies, and practices related to technology transfer, intellectual property, and innovation by excluding from additional duties certain products of China. The current 429 product specific exclusions (352 previously reinstated exclusions and 77 COVID-related exclusions) are scheduled to expire on May 31, 2024.

To provide a transition period for the expiring exclusions, the USTR has determined to extend all current exclusions through June 14, 2024. See Annex A and Annex B to the notice. The exclusions listed in Annex C to the notice are further extended through May 31, 2025. The exclusions listed in Annex D are not being extended beyond the 14-day transition period and will expire on June 14, 2024.
